These rules and regulations are adopted for the benefit of the homeowners of the units at Belvidere Townhouse Condominiums. They are intended to contribute to preserving a clean, attractive environment and to ensure the peaceful enjoyment of the condominium. They are not designed to unduly interfere, restrict or burden the use of the property.
All residents and guests are expected to abide by these rules which are meant to supplement the provisions of the Master Deed and Condominium Trust for the Condominium. Complaints of violations of these Rules and Regulations should be made to the Trustees and Property Management of Andover in writing. All written complaints must be signed with the unit number of the complainant. If the Trustees feel that the complaint is justified, they will take whatever action they deem necessary. The Trustees will notify the complainant, in writing, as to what actions have been taken.
Violations of the Rules and Regulations by a unit owner, a unit owner’s tenant or a unit owner’s guest(s) that are brought to the attention of the Property Manager and/or the Trustees shall be dealt with according to due process:
First Notice: The unit owner shall be notified that the Trustees have been alerted to a violation of the Association’s Rules and Regulations by the unit owner (or his/her guests and/or tenants). The owner will be asked to take specific corrective measures and will be provided a time limit for completing that task.
Second Notice: If the unit owner fails to take the required corrective measures within the time limit identified in the First Notice, punitive measures (including penalties or fines up to $50.00) may be assessed. A Second Notice will be sent to the unit owner that will describe any punitive measure taken along with the required corrective measure(s) and time limit to address the rule violation.
Third Notice: If the unit owner fails to take corrective action by the time limit specified in the Second Notice a warning will be sent to unit owner that their fine will be increased by $50 at the start of each day beyond the time limit specified in the Second Notice for the completion of the corrective action. Unit owners are responsible for all legal expenses related enforcement of the Associations Rules and Regulations.
Appeal Process: A unit owner may appeal punitive action taken by the Trustees for alleged violation of the Association’s Rules and Regulations. The appeal, in writing, must be received within 10 days of the Second Notice (i.e. the announcement of punitive measures being taken). The appeal may be sent by email or US Mail to BTC’s Property Manager. The unit owner must include their name, building and unit number, and the reason(s) for appeal.
The Trustees will consider the appeal and the information the unit owner provides and will communicate the result of the appeal process to the unit owner and our Property Manager as soon as possible. The Trustees decision on appeal will be final.
Amendment: These Rules and Regulations may be revised in any way at any time by the Trustees as conditions warrant, provided that written communication is sent to each unit owner advising them of the change.
